Last updated: 20 October 2026
Overview
Welcome to Lavender Froggies Arts.
Throughout these Terms of Service, the expressions “we”, “us” and “our” refer to Lavender Froggies Arts.
Lavender Froggies Arts is an independent creative business based in Edinburgh, Scotland, operated by a sole trader. We offer greetings cards and related creative products featuring photography, artwork and designs inspired by the natural world.
Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.
These Terms of Service govern your use of our website and the purchase of products through our online store.
Please read them carefully before placing an order.
By using our website, you agree to comply with the terms governing its use. When you place an order, the contractual terms applicable to that purchase will apply.
Nothing in these Terms of Service excludes, restricts or otherwise affects your statutory rights under applicable consumer protection legislation.
1. Access and accounts
You may browse our website without creating an account, although certain features may require you to provide personal information.
When placing an order, you agree to provide accurate and current information reasonably necessary to process payment, fulfil your purchase and arrange delivery.
If you create a customer account, you are responsible for taking reasonable steps to safeguard your login credentials and for notifying us if you suspect unauthorised use.
You must not knowingly use another person's account or provide misleading information.
We may restrict access to accounts where reasonably necessary to prevent fraud, unlawful activity or misuse of our services.
2. Our products
We take reasonable care to ensure that our products are accurately described and represented.
Product photographs, dimensions, materials and descriptions are provided to help customers make informed purchasing decisions.
Please be aware that colours may appear differently depending on screen calibration, device settings, lighting conditions and printing processes.
Minor variations in appearance may occur, but products will be supplied in accordance with their descriptions and applicable consumer protection legislation.
We may update product descriptions, discontinue products or change future product availability without prior notice.
Such changes will not affect existing orders that we have already accepted, except where permitted by law or agreed with the customer.
All products sold to consumers must be of satisfactory quality, fit for their intended purpose where applicable, and as described.
Nothing in this section limits your statutory rights.
3. Orders and acceptance
Placing an order through our website constitutes an offer to purchase the selected products.
An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.
A contract is formed when we confirm acceptance of your order.
We reserve the right to decline an order before acceptance where there is a legitimate reason, including:
-
A product being unavailable.
-
An obvious pricing or product-description error.
-
Payment not being authorised.
-
Reasonable evidence of fraudulent activity.
-
An order exceeding our available stock or practical fulfilment capacity.
If we cannot fulfil an order after payment has been collected, we will notify you and provide an appropriate refund without undue delay.
We may contact you to discuss practical arrangements for unusually large orders.
Once a contract has been formed, we will honour our obligations in accordance with the applicable terms and consumer law.
Order cancellations
If you wish to cancel an order, please contact us as soon as possible.
For most non-personalised goods purchased online, you have a statutory right to cancel from the time the contract is formed until 14 days after the goods are received.
Further information about cancellations, returns and refunds is available in our Returns & Exchanges Policy.
Nothing in these terms removes or restricts your statutory cancellation rights.
4. Prices, taxes and payment
All prices displayed on our website are in pounds sterling (GBP).
Prices include applicable taxes where legally required.
Any delivery charges are displayed separately before you complete your purchase.
We reserve the right to change product prices and promotions for future orders.
Price changes will not affect contracts that have already been formed.
Payments are processed through the payment methods made available by our ecommerce platform and its authorised payment providers.
You agree to use a payment method that you are legally authorised to use.
We do not knowingly retain complete payment-card details independently of our authorised payment processors.
If an obvious pricing error is identified before an order has been accepted, we may contact you to explain the error and offer you the opportunity to place a new order at the correct price.
We will not impose additional charges after a contract has been formed without your agreement, except where permitted by law.
5. Shipping and delivery
We currently offer delivery within the United Kingdom using Royal Mail.
Available delivery services, charges and estimated timescales are displayed during checkout.
We aim to prepare and dispatch orders within the processing times stated in our Shipping & Delivery Policy.
Delivery estimates are provided in good faith. They are not guaranteed delivery dates unless expressly agreed otherwise.
If a delivery is delayed, lost or damaged during transit, please contact us so that we can investigate and arrange an appropriate resolution.
Under applicable consumer law, goods generally remain at our risk until they come into the physical possession of the customer or a person identified by the customer to receive them.
An exception may apply where the customer independently commissions a carrier that we did not offer as a delivery option.
We remain responsible for meeting our legal obligations relating to delivery, including applicable rights concerning delayed or undelivered goods.
Further information is available in our Shipping & Delivery Policy.
6. Intellectual property
Unless expressly stated otherwise, the original photography, artwork, illustrations, designs, written content, logos, branding and other creative materials displayed on this website are owned by Lavender Froggies Arts, its proprietor or their respective rights holders.
These materials may be protected under the Copyright, Designs and Patents Act 1988, trade mark law and other applicable intellectual property legislation.
Purchasing a greetings card, print or other physical product does not transfer copyright or other intellectual property rights in the underlying creative work.
Except where permitted by law or authorised by the rights holder, you must not reproduce, scan, copy, distribute, modify, publish, sell or commercially exploit protected artwork or website content without prior permission.
Nothing in these terms prevents uses permitted by applicable copyright law.
You are welcome to contact us to discuss licensing, reproduction rights or authorised commercial collaborations.
Shopify and other third-party names, logos and trademarks remain the property of their respective owners.
7. Website use
You agree to use our website lawfully and respectfully.
You must not:
-
Attempt unauthorised access to website systems or customer accounts.
-
Introduce malicious software or interfere with website security.
-
Engage in fraudulent activity.
-
Misuse personal information belonging to other users.
-
Knowingly infringe intellectual property rights.
-
Use automated systems in a manner that unlawfully interferes with the website or circumvents reasonable security measures.
We may take proportionate steps to prevent or investigate suspected misuse, including restricting access where reasonably justified.
Nothing in this section prevents lawful browsing, accessibility tools, legitimate search indexing or other activity protected by applicable law.
8. Third-party links and services
Our website may include links to websites and services operated by third parties.
These may include payment providers, delivery services, social media platforms and other external resources.
Third-party websites operate under their own terms and privacy policies.
We do not control their independently published content and cannot guarantee its accuracy, availability or security.
However, the involvement of a third-party service provider does not remove our legal responsibilities in relation to purchases made from Lavender Froggies Arts.
9. Relationship with Shopify
Our online store is hosted by Shopify.
Shopify provides the ecommerce infrastructure through which customers can browse products, place orders and use associated services.
Purchases made through our store are contracts between the customer and the proprietor trading as Lavender Froggies Arts, rather than purchases from Shopify itself.
Shopify and its associated service providers may process information necessary to operate the store and its features.
Their involvement does not remove our obligations to customers under applicable consumer law.
Further information about personal information processing is available in our Privacy Policy and Shopify's published privacy information.
10. Privacy and personal information
We respect the privacy of our customers and website visitors.
Personal information may be collected and processed where reasonably necessary for purposes including:
-
Processing and fulfilling orders.
-
Taking payment.
-
Arranging delivery.
-
Responding to enquiries.
-
Managing customer accounts.
-
Preventing fraud.
-
Meeting legal and accounting obligations.
-
Providing marketing communications where permitted by law.
Our Privacy Policy explains the purposes and lawful bases for processing, the parties with whom information may be shared, retention arrangements and the rights available to individuals.
Where required, we will seek appropriate consent for non-essential cookies and similar technologies.
Please consult our Privacy Policy for further information.
11. Customer reviews and feedback
We welcome genuine customer feedback, reviews, photographs and suggestions.
If you voluntarily submit feedback for publication, you grant us a non-exclusive, royalty-free licence to reproduce, display and share that feedback for purposes reasonably connected with operating and promoting Lavender Froggies Arts.
This permission applies only to material you have the right to provide and does not transfer ownership of your original content to us.
We will not intentionally use private correspondence or unpublished customer material for promotional purposes without appropriate permission.
We may moderate or remove feedback that is unlawful, fraudulent, abusive, defamatory or infringes the rights of others.
We will not suppress genuine negative reviews solely because they are unfavourable.
Any collection or publication of personal information will remain subject to our Privacy Policy and applicable law.
12. Errors and inaccuracies
We take reasonable care to maintain accurate information on our website.
Occasionally, errors may occur concerning product descriptions, availability, pricing, images or delivery information.
We reserve the right to correct such errors.
Where an error affects an order before acceptance, we may contact the customer to explain the situation and discuss the available options.
Once an order has been accepted, any changes or cancellation will be handled in accordance with the contract and applicable consumer law.
Nothing in this section permits us to unilaterally remove or reduce a customer's statutory rights.
13. Prohibited activities
Customers and visitors must not use our services for unlawful purposes or in a way that causes deliberate harm to the website, its users or its operators.
Prohibited activities include fraudulent transactions, malicious interference, unlawful distribution of personal information and infringement of protected intellectual property.
We reserve the right to take lawful and proportionate action to protect our website and business.
14. Automated access
Automated access to our website must comply with applicable law and must not circumvent reasonable security controls or materially disrupt the operation of the store.
We may use appropriate technical measures to protect our website against harmful or abusive automated activity.
Nothing in these terms prohibits lawful accessibility technologies or activities that cannot legally be restricted.
15. Suspension or termination of website access
We may suspend or restrict access to website services where reasonably necessary to protect security, prevent fraud or respond to serious misuse.
Such action will be proportionate to the circumstances.
Suspending website access does not automatically cancel an existing purchase contract or remove any obligations or statutory rights associated with that purchase.
16. Product quality and statutory guarantees
We take reasonable care to supply products that meet applicable quality and safety requirements.
Under the Consumer Rights Act 2015, consumers have rights relating to goods that are faulty, not as described or not fit for their intended purpose.
Products will not be treated as supplied without statutory guarantees merely because they are handmade, artistic or produced using independent printing services.
Reasonable variations in photographic colour reproduction may occur, but these do not excuse a product that fails to conform to its description or applicable legal requirements.
Nothing in these terms excludes or restricts liability for failing to meet statutory consumer standards.
17. Limitation of liability
Nothing in these Terms of Service excludes or restricts liability for:
-
Death or personal injury resulting from negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of statutory consumer rights.
-
Any other liability that cannot lawfully be excluded or restricted.
We remain responsible for fulfilling our contractual obligations and supplying goods in accordance with applicable law.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.
Our products are principally marketed for personal use. Where a consumer purchases products for personal purposes, we are not responsible for losses arising solely from unrelated commercial activities, except where liability cannot legally be excluded.
Nothing in this section limits statutory remedies for faulty, misdescribed, damaged or undelivered goods.
18. Customer responsibilities
Customers are expected to provide accurate order information and use our website lawfully.
Where a customer deliberately or negligently causes direct loss through unlawful misuse of our website, we reserve the right to pursue remedies available under applicable law.
We do not require customers to indemnify Lavender Froggies Arts against our own negligence, contractual breaches or other liabilities where doing so would be unlawful or unfair.
19. Severability
If any provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will not apply to the extent of the invalidity.
The remaining provisions will continue to apply where they can operate fairly and lawfully.
Nothing in this section permits an unlawful or unfair term to be enforced against a consumer.
20. Entire agreement
These Terms of Service, together with our applicable store policies and any information forming part of an accepted order, set out the relevant contractual arrangements between Lavender Froggies Arts and the customer.
They do not override information or promises that applicable consumer law treats as binding.
Nothing in these terms prevents a customer from relying on statutory rights or on representations that legally form part of the contract.
21. Transfer of rights and obligations
Customers may not transfer contractual obligations to another person without our agreement where such agreement is reasonably necessary.
We will not transfer our obligations under an existing purchase contract in a manner that materially disadvantages a consumer or removes their legal rights.
Any transfer of business operations or contractual responsibilities will be handled in accordance with applicable law.
22. Governing law and jurisdiction
These Terms of Service are governed by Scots law.
Disputes may be brought before the Scottish courts, subject to any mandatory rights allowing a consumer to bring proceedings in another competent jurisdiction.
Customers residing elsewhere in the United Kingdom retain any mandatory consumer protections applicable to them.
Nothing in these terms requires a consumer to surrender legal rights concerning jurisdiction or applicable law.
23. Language
These Terms of Service are provided in English.
If translations are made available, we will take reasonable steps to ensure they accurately represent the English version.
Nothing in this section removes rights available under applicable law concerning contractual information or language requirements.
24. Headings
Headings are included for clarity and convenience.
They do not alter the meaning or legal effect of the provisions they introduce.
25. Electronic communications
By placing an order, you acknowledge that we may send communications necessary to administer your purchase.
These may include order acknowledgements, payment information, dispatch notifications, delivery updates and responses to customer-service enquiries.
Marketing communications will be sent only where permitted under applicable privacy and electronic marketing legislation.
You may opt out of marketing messages in accordance with the instructions provided and applicable law.
26. Changes to these Terms of Service
We may update these Terms of Service to reflect changes in our products, website, business arrangements or legal obligations.
The updated terms will be published on our website with an appropriate revision date.
Changes will generally apply to future purchases.
They will not retrospectively alter existing purchase contracts without a lawful basis or the customer's agreement.
Where legally required, we will provide additional notice of material changes.
